I feel very honoured to have been invited to contribute to this symposium. As a theme for today's discussion, I have chosen the notions of regionalisation and responsibility within Asia and the Pacific. I believe that the ability to accept responsibility for our neighbourhood, and to generate cooperative regional dialogues and actions to fulfill that responsibility will be the key to meeting the challenges and opportunities human rights will face in the new century.

The title of this session on the conference program is 'The history of human rights in Australian law'. I have chosen to slightly change the topic for a number of reasons. The main reason is because Indigenous peoples' struggle for recognition of their human rights remains to a large extent unfulfilled. Consequently, it is not, and has never been, well reflected in Australian law. Second, because human rights continue to be poorly and rather patchily implemented in our legal system.

Good afternoon ladies and gentlemen. Welcome to the launch of the report of the national inquiry into the human rights of people with mental illness. This report is the result of extensive research; public hearings in all States and Territories; and oral evidence and written submissions from over 1300 witnesses. I have been extremely fortunate to have the assistance of two commissioners with a long standing interest in the area of mental health - Dame Margaret Guilfoyle and Mr David Hall.

Since the terrorist attacks on September 11 2001, Governments around the world have created a raft of new counter-terrorism laws. In Australia alone, over 40 new laws have created new criminal offences, new detention and questioning powers for police and security apparatus, new powers for the Attorney-General to proscribe terrorist organisations, new ways to control people’s movement and activities without criminal convictions, and new investigative powers for police and security agencies.

I am honoured too to be able to commemorate the work of Sidney Sax, one of the most significant people shaping health care policy and practice in Australia.

This paper advocates that National Human Rights Institutions (NHRIs) have a very valuable role to play in the Pacific, and that the promotion and protection of human rights in the Pacific would benefit immensely by Pacific nations each establishing a NHRI.
