The following kind of relates to marriage as well because without marriage, staff can't utilise these benefits and because we are a same sex couple who can't get married we can't get these benefits. If we were to get married overseas, would the airlines be expected to recognise this and give us interline travel? I hope the following information is helpful in this inquiry.    SAME SEX DISCRIMINATION, BASED ON MARITAL  GROUNDS.       BACKGROUND   As may be widely known, airline staff are usually able to obtain free or discounted travel on the services of their own airline.  This is known as staff or privilege travel.  Most airlines offer this benefit to the staff member and their married, de-facto, as well as same-sex de-facto partners and some airlines allow a travel buddy to access the facility.   Importantly, many airlines also have a reciprocal industry arrangement, whereby airline staff can obtain similar benefits for travel on other airlines, known as interline travel.  Interline travel may benefit staff when their own airline doesn't fly to the country or on the route the staff member wishes to travel on.       It is interline travel that is the focus of this submission.     APPLICATION OF INTERLINE TRAVEL BY AIRLINES   Airlines grant interline travel on an application and approval basis and according to strict eligibility criteria.   The most significant benefit is whereby a married heterosexual staff member would be able to access interline travel benefits for themselves and marital partner, at free or highly discounted rates.   Unmarried staff, even of heterosexual orientation are not usually eligible to apply for interline travel.      EXAMPLE OF DISCRIMINATION   Couple X, married heterosexual  people.   An airline staff member works for airline A which does not fly Tran-Tasman routes.   Airline B does and the airline A staff member and married partner (heterosexual married couple) are able to fly from Sydney to Auckland, both for free under the interline travel benefit using airline B, in order to visit parental family members.   Couple Y, long term gay (but legally unmarried)  people.   Using the same example, an unmarried gay airline staff member works for airline A which  does not fly Trans-Tasman routes.   Airline B does and only the airline A staff member is able to fly from Sydney to Auckland for free under the interline travel benefit using airline B, in order to visit parental family members.  However, since the airline staff member is an unmarried gay person, they are unable to access the same interline travel benefit for their long term partner and thus must pay commercial rates for the partner to visit the parental family members.      EFFECT OF DISCRIMINATION   Over the 12 month period, the cost to couple Y of buying commercial airline tickets twice a year is approximately AUD$1,000. If the gay couple Y was allowed to marry and therefore be recognised under the interline travel benefit, this cost would not occur.   Further, the added cost of buying commercial airline tickets makes it impossible for the gay couple Y to visit family members as often as the heterosexual couple X, who travel for free four times a year to  visit family.
