Main points are: 1. Contributions to PSS or CSS. Comsuper legislation specifically excludes same-sex relationships when it comes to reversionary death benefits. The definition of spouse for superannuation purposes within the public sector schemes means a partner of the opposite sexit includes only heterosexual partners. Therefore, the death benefits payable from the Commonwealth defined benefits superannuation schemes are payable only to a members opposite-sex spouse, either de facto or married. Same-sex partners of deceased members who are not classified as a spouse are denied access to these benefits, where for other superannuation schemes they have access. 2. Legislation also excludes same sex couples for superannuation spouse co-contributions, spouse rebates and splitting superannuation contributions.
