As I am a practicing gay man, it -determines that I am a law-breaker if I donate semen. This is the case if I do it privately or at a clinic. The legislation was set up in 1983, at the beginning of the HIV epidemic. Now, 23 years later there are testing procedures in place that would avoid HIV being transmitted in this way. (At a clinic, the semen is stored then the donor is re-tested 6 months later. If he is found to be HIV negative the semen can be used. If he has become HIV positive, the semen can be destroyed.) Gay men are being discriminated against as they are not able to be a sperm donor in a clinic. The act is also deemed illegally if done in a private manner at home. Lesbians are also not able to legally access semen from gay men through artificial insemination. The reality is that the Human Tissues Act (1983) is out of date, and discriminatory.
