Even if these exemptions are included in the proposed Federal Law with regards to this issue, I have grave concerns that the Law would, by default, discriminate against Australians of religious faiths, particularly those who congregate as a community of Catholic and Protestant believers.  There has been evidence of occasions already that reflect the loss of freedom of speech as a Christian.  The Religious Freedom Act has in the past been effected by complainants as a means to limit free and peaceful expression of religious values within the Christian church and its extended community of organisations and community based work places. The Two Dannies case is only one such example.  This case is an example of the absence of Freedom of Speech and Religious Freedom. It is a case that demonstrates that the "law" can be used to intimidate, to distort the truth of what was said/done within a religious context of a community of people sharing the same faith. This case causes me great concern as I grew up in a Muslim country and have experienced State controlled/forced 'law' that 'makes' criminal anyone of non-Muslim faith who dares utter anything that could be construed as an attack on Islam. I can attest to your Committee fully that such a 'law' is in no way 'anti discriminatory' - it is merely autocratic and respects no other religious or human rights in the form of freedom of religion or of human rights. It supports, by force, only one religion and people of that one faith. I fear greatly that Australia, in its eagerness to be diplomatic, 'tolerant' and 'all-accepting', is allowing our freedoms to be dictated by those who have loud voices and who take advantage of our nation's goodwill and humane laws. I fear greatly that, again, this proposed Discussion Paper supports protection of LGTBIs but to the detriment of religious communities like churches, church owned property rights and organisations that do not come directly under the auspices of a church but were (or will be) established by various Christian communities to provide business, humanitarian, charitable, social and educational services to the community at large.  Most, if not all of such Christian motivated, resourced and establishment of these organisations are funded from people who share the Christian faith. The services they provide relieve the Local, State and Federal Governments in a multitude of social care of the communities concerned.  As a side, but related issue, hospitals such as St Vincent’s in Sydney were founded by Christian religious faithfuls. The hospital continue to provide amazing care, love and support in all ways to people who suffer from AIDS and LGBTI related illnesses. I would ask any LGBTI to go visit the AIDS unit at St Vincent’s Hospital and then express any complaints they may have about discrimination against them by the wonderful staff there (many of whom are of the Christian or Catholic faith) who care for all under their care with great respect and integrity. It troubled me greatly that a church was fined for not renting their premises out to a LGBTI youth group. Is a church not allowed to use or provide their facilities for use that supports and fall within the values of their religious faith?  The verdict in this case shockingly highlighted that this was anti-discrimination in reverse. The Exemption allowed in VIC was not even considered - it was solely based upon the particular judge assigned to the case. As such, there is no consistency in the application of the Exemption. In the absence of evidence of any communication “made in public that incite ‘hatred towards, serious contempt for, or severe ridicule of,’ a person or group of people on the ground of their sexual orientation and sex and/or gender identity” churches, church related organisations, non church based Christian organisations should have the freedom to speak, discuss and teach their values without fear of being fined. I have little confidence that any discussion spoken or written in any form (public space, multimedia, religious worship services) that expresses a view different to LGBTIs gender values would be considered as ‘free’ within the context of this Discussion Paper. This is a complete loss of Freedom of Speech! Can only some sections of the Australian community have freedom of speech but not others? Can people no longer hold a different view? Is it illegal to disagree when one does not incite hatred, encourage serious contempt or severe ridicule? Can religious organisations or facilities they own no longer be used for activities supporting their faith? Will they be forced by law to rent their facilities to anyone? – Loss of Property Rights Will the church, or the mosque, or the Buddhist temple be forced to rent their facilities against their will? Can LGBTIs force churches, mosques and temples to let them use their facilities? Should Christians be allowed to force a mosque or Muslim owned facility that was built for the use of Muslims to be rented out to them and conduct activities that included the cooking and serving of pork in the name of anti- discrimination? Or to hire Muslim owned facilities and conduct meetings/activities that show blatant disrespect to Muslims? The issue here is sensitivity and harmony.  The issue is not anti discrimination. Christians should show respect to the Muslim faith and vice versa. Churches and Christians are to (and many do) show love and care to LGBTIs but they do not have to agree with the values of LGBTI nor compromise their own religious values. If the law states that Christians MUST compromise the values of their faith then Australian Christians and Churches no longer live in a country that supports Religious Freedom. Australia becomes a country that discriminates against certain faiths, Christianity being one of them. My faith in Jesus Christ is real, and as an Australian, I have the right to pursue and live out my faith in freedom and without threat of persecution. The church community that I am a part of should have the freedom to teach, encourage, minister and care for their community of believers (and non believers in their local community) in freedom, integrity and faithful pursuit of their religious beliefs. They should be allowed to use their facilities in ways that support their values according to their faith. Let us be mindful that none should support the abuse and victimisation of anyone who identifies themselves as LGBTIs. We cannot and should not support the abuse and victimisation of any human being (or animal for that matter). In the fair pursuit of standardising protection for LGBTIs there must, however, be clear and consistent consideration given to the exercise of proposed Federal anti discriminatory laws. There needs to be consistent, fair, respectful and legally effective exemptions that allows for the freedom of speech, freedom of practice of religion and respect of property rights of religious communities/organisations. Legalising anti discrimination against LGBTIs by removing freedom of speech, religious freedom and property rights of communities of faith would result in a win/lose outcome. The Committee needs to engage great wisdom and consider a solution that is a win/win for all parties. This requires clarity and courage in thinking and application of just Federal Laws that are made and based upon fairness, harmony and justice for all and not be pressured by the desire to merely establish a ‘tolerant’ or ‘accepting’ law with little consideration for the freedom of speech, practice of religion and protection of property rights for all Australians.
