We submit the following comments for your consideration: Terminology In many CALD communities, it is often difficult to bring up issues of sex and sexuality as traditionally, these subjects have either been taboo or referred to only in relation to heterosexual marriage and family. The terminology used in various commonwealth and state legislation may seem a world away from communities’ points of reference, making it extremely challenging for young people of migrant and refugee backgrounds to “come out” to their communities and use these legislative tools to combat discrimination. Language can be a powerful symbolic medium by which concepts are transmitted. Certain words when translated lose part of the original meaning or may have no direct translation into another language. For instance, the Thai term kathoey is often translated as homosexual in English. However, in Thailand, kathoey refers to effeminate men who have sex with men, while the term itself is a descriptor of sexual preference as well as a gender description – the full meaning of which is lost when translated into English. The labels ‘homosexual’, ‘lesbian’, ‘gay’, ‘straight’, and so on have been constructed mainly through western notions of identity and sexuality. In some cultures, these categories may have no meaning in their culture or social circumstances as for eg, “men who have sex with men” may not necessarily identify as being ‘gay’ or ‘bisexual’. In some cultures, sex between people outside the heterosexual norm is tolerated as long as it is not spoken about. The same sex partner may be considered and treated as part of the family but the relationship is never stated as such. Benefit of anti-discrimination laws Anti-discrimination laws on both federal and state levels would help greatly in the broader community awareness of LGBTI issues and the areas in which discrimination can and do happen for this group. Given the issues above (re: terminology) for CALD communities, and the anecdotal evidence that CALD communities are less likely to report or take formal action, a national action plan on human rights is an area where more work needs to be done with specific actions and measureable outcomes for CALD communities. Some of the actions could include: Community education programs: these programs must include the communities in scoping a strategy that “speaks” to their community. This could include using the notions of human rights to contextualise the diversity of identities. Using community or bi-lingual workers to explain and de-mystify the legislation and the process for using the legislation as remedy for discrimination. Using the states’ EOCs to promote community education as it is seen as an ‘objective’ and widely recognised institution by CALD communities.
