Graham Stanton Principal Youthworks College Youthworks is the youth ministry arm of the Anglican Diocese of Sydney, and Youthworks College trains people for ministry to youth. Through its camping ministries and via NSW's provisions for special religious education the organisation has extensive contact with children who attend both government and independent schools. This submission to the Project is relates to two discussion paper questions. Q7.1: Is there satisfactory freedom of cultural expression and practice within the normative social and legal framework? While the legal freedoms of Christian students are clear, the 'social framework' in some schools has inhibited 'satisfactory freedom of cultural expression and practice' for Christian students. Concern centres on three areas: the freedom for Christian students to gather together during lunch times; freedom for Christian students to express Christian convictions in class discussions; and the freedom for Christian students to speak openly of their Christian faith to other students. Gathering together for mutual support and encouragement and corporate worship is a central feature of Christian life. This is no less true for Christian school students. Many schools have Christian groups who gather over lunch once a week for this purpose. These gatherings are particularly important for Christian students who do not attend weekend church services or whose weekend church services do not have the same level of peer support and involvement. Some schools make it difficult for such students to gather by making classrooms unavailable or by scheduling other significant out of class activities (such as music, drama or sporting activities) across all available lunch or recess breaks. The freedom to have a regular weekly gathering for students from all schools years is thereby inhibited. Christianity seeks to understand all of human life and learning in relation to the Christian faith. The interaction between Christian faith and the school curriculum is particularly prominent in subject areas such as English (through the interpretation of texts and the relevance of these messages for human life), HSIE and science. Christian students who seek to articulate Christian theological commitments in these subject areas have been intimidated and mocked by teachers who do not respect their freedom to express their Christian faith. It is legitimate (and expected) that teachers would push students to ably defend their views in a cogent and respectful manner within a multi-cultural and multi-faith setting, but there are concerns that Christian young people are being ridiculed for holding Christian views irrespective of their ability to defend them. Lastly, Christian school students have not always been free to speak openly of their Christian faith among their peers at school due to pressure from teachers and school administration against proselytising. While it is appropriate that proselytising not be a feature of the school system it is inappropriate for this activity to be prohibited among students themselves as free members of the society. Q1.1: What are areas of concern regarding the freedom to practice and express faith and beliefs, within your faith community and other such communities? While we recognise that the SRE (Special Religious Education) provisions in New South Wales are a matter of State rather than Federal legislation, we are concerned that any Federal initiative may be used to limit or remove the access of religious education providers to New South Wales Government schools. We are concerned that opponents of SRE will argue that this provision is discriminatory to people who have no formal religion. This is particularly seen in the moves by the Parents and Citizens Association (P&C) to promote a secular ethics program to run in competition with SRE classes. It is important to point out that SRE has a long history in New South Wales and has proved to be beneficial for promoting the understanding of religion within the school community. Students who are not themselves Christian but who participate in SRE according to their parents' request have found the opportunity to learn about Christianity in SRE a great benefit to their education. Similarly, teachers and principals who are not Christian have affirmed the value of the SRE program and noted the positive involvement of SRE teachers in the school community. It would be particularly concerning if any federal legislative changes with respect to the Freedom of Religion were to undermine the existing NSW State legislation that has proved to not be a threat to the freedom to practice and express faith and beliefs in government schools.
