Q3.2: How should government accommodate the needs of faith groups in addressing issues such as religion and education, faith schools, the building of places of worship, 1. Land Availability: Many religious organisations want a physical presence in new and developing housing estates, close to the communities they seek to serve. Generally, to purchase land, negotiations need to take place with the developers of those estates. However, given the need for the developers to earn a commercial return, the price of land is often prohibitive for religious organisations. The cost of land, particularly in Sydney, is a serious constraint to religious organisations having a physical presence in new housing areas. 2. Community facilities owned by local municipal councils or schools are generally insufficient to meet the competing demands of the different religious groups and other community organisations. 3. Planning policies: Planning policies can create special difficulties for religious organisations. Some local councils have development control plans which impose special restrictions of the use of land and buildings for places of public worship. 4. Generally, planning policies require that sufficient parking be available for public meeting facilities. The need for policies of this type is not disputed. However, the cost of providing car parking exacerbates the difficulty of funding the cost of development. Planning policies should encourage greater joint-use of parking facilities (for example, the location of religious meeting places near schools or shopping centres to enable shared use of parking facilities). 5. Heritage laws: Heritage laws are intended to protect buildings which are considered to be of community significance. But where a building is listed on heritage grounds, the listing imposes restrictions on its use, and limits the potential for development and adaptive re-use. Development can be important as a source of capital for ensuring listed buildings are maintained to an appropriate standard of repair and maintenance, particularly where the level of government funding support for heritage buildings is generally not commensurate with the additional obligations imposed by listing on the owner of the relevant building. Q1.3: Is there adequate protection against discrimination based on religion or belief, and protection of ability to discriminate in particular contexts? 6. Use of Church land: Typically, land and buildings owned by religious organisations are made available to a wide range of community groups for their use. From time to time Government instrumentalities have proposed that laws (particularly anti-discrimination laws) be changed to make it unlawful for organisations such as religious organisations to deny the use of property by a person or persons whose beliefs or practices, in an extreme case, are hostile to the fundamental tenets and beliefs of the religious organisation. To date, such proposals have not generally been enacted into law. However, for religious organisations to continue to make their property available for the use of community groups, their right to restrict access needs to be preserved. Otherwise, such organisations may need to prevent all community groups from using their facilities to minimise the risk of claims by a specific group of unfair discrimination. The loss to the community of the use of facilities owned by religious organisations would be significant. Q7.5: Are there any issues in regard to participation in the faith community for people with disabilities? 8. Disability access: Primarily, by reason of their age, many of the buildings owned by religious organisations do not comply with modern building code standards, such as standards for disability access. Regrettably, this means that access by disable people to some buildings is restricted. In some cases substantial expense needs to be incurred in ensuring that such standards and key occupational health and safety requirements are met. While most religious organisations are very sensitive to the need to meet these requirements the limited availability to funds restricts the ability to undertake these works in a timely manner.
