NSW 1. INTRODUCTION The child care centre is proposed as a result of an alterations and additions to an existing residential dwelling at the above mentioned properties. The proposed child care centre has utilised almost an entire existing footprint of an existing residential dwelling for its utilisation commensurate with the provisions of the 鱨վ Services Regulation 2004. During this process, the facilities complied with access provisions in accordance with AS 1428.1 in respect to all parts of the proposal only to deter away from AS1428.1 compliant access provisions in regards to a toilet within the centre. 2. THE DDA AND THE CHILD CARE CENTRE'S RESPONSIBILITIES Under the disability discrimination act 1992, section 23 access to premises, (1) It is unlawful for a person to  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "discriminate" discriminate against another person on the ground of the other persons  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "disability" disability or a  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "disability" disability of any of that other persons  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "associate" associates: (a) by refusing to allow the other person access to, or the use of, any  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "premises" premises that the public or a section of the public is entitled or allowed to enter or use (whether for payment or not) It is clear that this child care centre provides a venue for the caring of children in accordance with the 鱨վ Services Regulation 2004. It subsequently has the responsibility under section 23 of the Act as mentioned, however, it is noted that the existing room containing the toilet propositioned does contravene the spatial requirements under AS1428.1 for a person with disability to utilise the WC. While acknowledging responsibilities under section 23 of the DDA, the child care centre also notes that: (2) This section does not render it unlawful to  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "discriminate" discriminate against a person on the ground of the persons  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "disability" disability in relation to the provision of access to  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "premises" premises if: (b)any alteration to the  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "premises" premises to provide such access would impose  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "unjustifiable_hardship" unjustifiable hardship on the person who would have to provide that access. Where this unjustifiable hardship was defined in the disability discrimination act 1992 - sect 11 as, (c) the financial circumstances and the estimated amount of expenditure required to be made by the person claiming  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "unjustifiable_hardship" unjustifiable hardship. With regards to this unjustifiable hardship it is noted that the process of providing a hierarchy of spaces to care for children in their set numbers rely on adequately quantifiable spaces. The process of providing sufficiently spaced toilet in accordance with AS1428.1 would have resulted in the loss of critical spaces and meant the demolition of an existing load bearing walls in the process. Furthermore, this process would have entailed further expenditure in regards to the overall extension of the dwelling causing greater bulk and massing to the overall building. 3. THE IDENTIFIED BARRIERS FOR PEOPLE WITH DISABILITIES IN ACCESSING THE SUBJECT TOILET AT 13-15 RUGBY CRESCENT CHIPPING NORTON. NSW The subject premise is accessible by people with disabilities from Rugby Crescent Chipping Norton, as the entrance doors have no pronounceable lip in the threshold. All of the child care centre areas from this level is able to be accessible by people with disability commensurate with AS1428.1-2001. However, towards the heart of the proposed child care centre, a toilet is proposed without provisions made for disabled access around the WC in accordance with AS1428.1 With this noted, it is confirmed that within this Toilet room the following are provided:- Adequate clearances around the main access door to AS1428.1-2001 The main access door with Braille Signage to Part D3.6 of BCA and AS 1428.1 -2001. 30mm stainless steel grab rail at 800mm from FFL to wall adjacent to WC to same wall where cistern is mounted. L shaped 30mm diam, stainless steel grab rail a 800mm from FFL and extended to 1400mm from FFL (option(ii) of Fig 21 of AS1428.1-2001) Hand basin mounted 800mm above FFL and type to provide clearance as noted in Fig 23 of AS1428.1-2001 All with the exception of providing sufficient clearance forward of the WC, where 625mm is provided in lieu of 1200mm being required. It is noted that the possible rectification works to allow the required 1200mm clearance forward of the WC whilst satisfying all other spatial criteria for a satisfactory functioning disabled access toilet, the following would be required. The demolition of an existing wall forming the Toilet enclosure thus rendering the uselessness of a laundry existing to allow proper functioning of the child care centre. If walls bounding the toilet is to be demolished allowing for an increased 575mm to allow 1200mm circulation area forward of the WC, then the whole of the laundry has to be relocated further towards the front of the building resulting in modification and relocation of other spaces' existing fenestrations as well as the extent of other spaces. Demolition of the walls of the toilet would have consequent chain reactive affect and would need to have other spaces forward of the toilet towards the front of the building rendering the ineffectiveness of all the existing internal walls in its attempt to support dead loads of an existing roof framing system. 4. Proposed action to overcome identified barrier Although there is the chance that a defense of unjustifiable hardship would be available to the child care centre in the event of a complaint, it is the centre's decision to contribute certain portion of funds to allow for early warning system to be installed so that physical help is provided to the disabled person needing aid with accessing the provided WC. A buzzer or other similar intercom system will be installed linking it with a primary contact staff of the child care centre. This button shall be installed in accordance with the requirements of AS1428.1 clause 11.2 and shall involve the installation of the following:- Rocker action, toggle or push pad switches with a recommended width of 35mm. This will allow further disabled people with regards to severe finger or hand disabilities to allow convenient operation by arm or elbow. Braille signs to alert the provision of this switch provision. 5. THE MONITORING AND EVALUATION PROCESS The child care centre licensee will be responsible for ensuring the action is completed. The licensee will also initiate a customer feedback system by proposing a mail box type system near the counter requesting patrons to provide a feedback based on any range of issues while they were using the centre's facilities at 13-15 Rugby Crescent Chipping Norton. It is proposed that upon receiving the comments on a daily basis, the manager will oversee the comments and tabulate the comments based on the type affecting the child care centre. i.e. Staff attitude related; Access to toilets related Within the contact details in the feedback comment, issues relating to access to premise's toilet based on disability will be responded with a mailout of the disability action plan that has already been forwarded to the Human Rights and Equal Opportunity Commission. 6. REVIEW OF THE ACTION PLAN The review of progress towards achieving the intended measures of providing assisted access to the disabled WC for disabled persons will occur on a yearly basis.
