'..'OOOOOOO((OOO)OOOO.OOOOOOOOO : D i s a b i l i t y A c t i o n P l a n for Proposed Recreational Facility at Unit 15/6 Victoria Avenue Castle Hill 1. INTRODUCTION The commercial development at the above mentioned building is proposed as a recreational facility for Family Self Defence Academy. This facility is accessed by a staircase at both ends of the building. Surrounding tenancies consists of commercial retail premises at the ground floor level and first floor levels throughout the complex. Disabled access is provided on the ground floor levels with staircase being resorted to the only means of access for the subject facility to the upper 1st floor level. 2. THE DDA AND DEVELOPER'S RESPONSIBILITIES Under the disability discrimination act 1992, section 23 access to premises, (1) It is unlawful for a person to  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "discriminate" discriminate against another person on the ground of the other persons  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "disability" disability: (a) by refusing to allow the other person access to, or the use of, any  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "premises" premises that the public or a section of the public is entitled or allowed to enter or use (whether for payment or not) or While acknowledging responsibilities under section 23 of the DDA 1992, the tenant also notes that: Section 29A of DDA 1992 reads, "This division does not render it unlawful for a person (the discriminator) to  HYPERLINK "http://www.austlii.edu.au/au/legis/cth/consol_act/dda1992264/s4.html" \l "discriminate" discriminate against another person on the ground of a disability of the person if avoiding the discrimination would impose unjustifiable hardship on the discriminator" When ascertaining the hardship, it is explorable along two avenues. 1. Immediate capital expenditure involved to accommodate for a lift that will provide the people with disability access from the ground floor level to the subject premise's upper floor level having difference of approximately 3.3metres. This would involve major penetration of the existing slab taking further areas of an existing retail tenancy located on the ground floor not to mention undermining the structural integrity of the reinforced concrete slab currently forming the floor for the upper 1st floor level. 2. Immediate capital expenditure involved to accommodate a staircase chair lift to multiple flights of staircase with further 1:14 grade ramps to allow for disabled access from different levels within the tenancy. The existing staircase located at the two opposite ends involve on both cases, multiple flights of staircases with the staircase chair lift installation within the stair an improbable task. For the northern stair, there are THREE separate flights of stairs which would prove the installation of a chair lift impossible. The southern staircase involve a TWO separate flights of stairs with a trapezoidal mid landing which would prove an installation of chair lift impossible. Furthermore, internal step changes to the main floor levels are more than 190mm which would not allow the use of steep step ramp @ 1:8 to AS1428.1. The adoption of the ramp at 1:14 slope is required meaning 4.06 lineal metres of ramp must be provided for the main steps existing within the building in two locations. 3. THE IDENTIFIED BARRIERS FOR PEOPLE WITH DISABILITIES The subject premise's access staircase is accessible by people with disabilities from Gladstone Road from the ground level. Alternatively access from the existing car park is made possible from the north with the 3 flights of staircase giving access to the subject tenancy at the upper level. With this noted, it is confirmed that within this developments the following are provided:- All staircase at the ground floor being provided with disabled access in accordance with AS1428.1-2001 Sanitary facilities with adequate unassisted spatial access to all patrons of the site to part F2.3 of the BCA and access provisions to AS1428.1-2001 located to the west of the site. 4. Proposed action to overcome identified barrier The proposed units along the ground floor level represent series of class 6 retail tenancies as defined using the deemed to satisfy verification method of the BCA. As such, disabled access is provided into the individual tenancies with access off the footpath commensurate with AS 1428.1-2001. From these retail units, I have mentioned the access into a disabled access sanitary facility via the side access paths also commensurate with the AS 1428.1-2001. Now, in regards to the subject tenancy on the upper level, we reveal that a "secure" landing is provided sufficiently forward of the access compartment commensurate with AS1428.1-2001 in respect to circulation required around the doors. This security is achieved by having the door at the bottom of the stairs, with access to these doors occurring either of two following ways as options:- Key or swipe card operation by person intending access. Alerting the occupants of the units accessible for manual unlocking of the security doors via electronic intercom system. With this sense of security maintained, we note that both cases would allow the proposed staircase to be an access problem only if the party intending access of the respective premise are disabled with wheelchair limitation. With the business's pre booking system of membership, a guided access provisions for the disabled people will be pre organised, so that manually assisted lifting techniques can be used to provide access up the stairs into the subject tenancy's upper first floor level for the people with wheelchair disability. Having said this and although there is the chance that a defense of unjustifiable hardship would be available to the development in the event of a complaint, it is the business's decision to contribute certain portion of funds to allow for early warning systems and appropriate pathfinding systems to be installed so that psychological/physical guidance is provided to the disabled person needing aid with unassisted, equitable and adequate access up to the staircase as follows:- a. Graphic and Braille Signs (AS1429.1-2001) installed to show the alternative route to the northern end of the site, located upto the doors to AS1428.1-2001. b. A suitable simplified intercom system installed to base of stairs outside of the doors (north and south) to a height satisfiable to FIG 31 & Clause 11.1.2 of AS 14281-2001 being 900mm to 1100mm above Finished Floor level of the footpath. OR c. A Disabled access / Braille sign (AS1428.1-2001) installed to single swing door located at the end of the north and south stair lobby with an electronic switch type and installed to clause 11.1.2 of AS 1428.1-2001 to allow for operation of the door. d. Suitable tactile buttons to AS1428.4 being installed to existing staircases for people with other disability in accordance with AS1428.1 e. Suitable Braille signs installed within the confines of the internal part of the common spaces alerting the directions to the internal access points of the northern and southern staircase. 5. THE MONITORING AND EVALUATION PROCESS The business trading out of the subject facility will be responsible for ensuring the measures are implemented. With the ongoing maintenance of the system to be instilled within the function of future staff of the business. The business will also initiate a customer feedback system by proposing a mail box type to be lodged to provide a feedback based on any range of issues while they were using the common facilities of the centre. It is proposed that upon receiving the comments on a daily basis, the manager will oversee the comments and tabulate the comments based on the type affecting the Development as a whole. i.e. Disabled Access into centre, attitude related; access to disabled toilets related; and any intercom function related. With the contact details pertained within the feedback comment, issues relating to access to development based on disability will be responded with a mailout of the disability action plan that has already been forwarded to the 鱨վ and any subsequent revisions. 6. REVIEW OF THE ACTION PLAN The review of progress towards achieving the intended measures of providing predefined access to the centre for disabled persons will occur on a yearly basis.
