In implementing this action plan the Blue Mountains City Council will more adequately address its responsibilities under the Disability Discrimination Act 1992 (DDA). In broad terms the DDA requires service providers whether public or private organisations, to make their services and facilities accessible to people with disabilities. Developing and implementing a Disability Action Plan is a voluntary, proactive approach to complying with the DDA. Registering the action plan with the Human Rights and Equal Opportunity Commission (HREOC) places the name of the organisation on its register. No formal assessment by the Commission of the Disability Action Plan takes place. In the case of a disability discrimination complaint to HREOC, presenting an action plan and discussing implementation issues may promote conciliation. More formally, a Disability Action Plan may be referred to during a hearing as part of a respondents defence under the DDA. This draft Disability Action Plan was developed in conjunction with the Mountains Community Resource Network: Disability Community Development Project, and involved consultation with the Blue Mountains Community Access Committee and Council's Access and Equity Working Group. It is recommended that Council adopt this Disability Action Plan and register the plan with the Human Rights and Equal Opportunity Commission as a strategy for eliminating disability discrimination.
