The objectives of this Strategy are to create awareness of racism and how it affects individuals and the broader community; identify, promote and build on good practice initiatives to prevent and reduce racism; and empower communities and individuals to take action to prevent and reduce racism and seek redress when it occurs (Human Rights Commission, 2012). Shelter SA welcomes the opportunity to contribute a submission to the Anti-Racism Strategy addressing the aforementioned objectives. Shelter SA Shelter SA is the South Australian peak body for housing and homelessness. Shelter SA advocates for the interests of low income and disadvantaged South Australians and their housing needs via policy work, research and education. Shelter SA promotes the right of every person to access and maintain affordable, safe and secure long-term housing that they identify as appropriate to their needs. Shelter SA is a member organisation and members represent a diverse range of stakeholders including government and non-government organisations, private sector agencies and interested individuals. Shelter SA supports two branches comprised of service providers that represent special interest groups: the Aboriginal Homelessness and Housing Support Branch and Agencies Supporting Housing for Refugees and Asylum Seekers (ASHRA) that represent the concerns of Indigenous Australians (Indigenous people) and refugees and asylum seekers respectively. The housing concerns of Indigenous people and refugees and asylum seekers are discussed in this submission. Aims of this Submission In this submission we aim to: Outline how racism plays a role in the issues and problems experienced by Indigenous people, refugees and asylum seekers and culturally and linguistically diverse people (CALD) more broadly and; Get housing on the agenda as a fundamentally important area in which Indigenous people, refugees and asylum seekers and CALD people experience discrimination that is driven by racism. Housing for Refugees and Asylum Seekers, CALD and Indigenous People: The Challenges Housing is a human right. This human right is reflected in the Universal Declaration of Human Rights, in which it is stated that: Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care. (Article 25 emphasis added) Equal recognition of the rights of all people is the foundation of freedom, justice and equity (ibid.). Access to housing, as one of the most basic human rights, is fundamental to the creation of a just and equitable society in which people can realise their basic needs and establish a sense of belonging. Not all people have equitable access to housing. Refugees and asylum seekers and CALD people more broadly face a competitive private rental market in which vacancy rates are low, rents are high and with additional barriers around rental history, language and culture (Beer and Foley, 2003). In Shelter SAs 2011 submission to the South Australian Housing Strategy it is stated that: The politicisation of Australias responsibility to protect refugees and asylum seekers has contributed to negative stereotypes and experiences and contributes to marginalisation and disadvantage in their attempts to access the private rental market. (Shelter SA, 2011:15) It has been noted that housing is essential for the successful settlement of refugees and asylum seekers (Berta, 2012, Refugee Council of Australia, 2011) and housing has also been described as a marker of successful settlement (Ager and Strang, 2008). For humanitarian entrants, settlement in Australia is a process that proceeds through what service providers (organisations such as Anglicare and the Migrant Resource Council who provide numerous supports including housing assistance, education and many other support programs and activities) refer to as settlement, un-settlement, and re-settlement. This is linked to the early housing careers of humanitarian entrants that see them provided housing for 6-12 months under the Humanitarian Settlement Scheme (HSS), their movement into the private rental market which is often marked by difficulty in accessing housing and uncertainty of tenure, and their subsequent re-settlement in the private rental market. Indigenous people have specific housing needs and face significant barriers to accessing and maintaining housing due to discrimination and racism (Shelter SA, 2011). The high representation of Indigenous people amongst the homeless population and the issues they confront in housing, have distinct qualities that are located within a particular Indigenous framework that relates to the historical, social and cultural context of the Indigenous experience of housing. In examining how colonialism has displaced, dispossessed and excluded Indigenous people from participating in the cultural, economic and political development of Australian society, it is clear that white race privilege continues to position Indigenous people in an environment that maintains and reinforces dominant white, European culture. When compared to the non-Indigenous population, statistics relating to the health, life expectancy, child mortality rate, unemployment and homelessness of Indigenous people demonstrate major, negative differences. These social factors indicate that the prospects, life choices and opportunities for Indigenous people are considerably less than those of the non-Indigenous population. It has been noted in a recent Australian Housing and Urban Research Institute report that the private rental market significantly contributes to homelessness among Indigenous people in urban areas (Milligan et al., 2011). The role of the private rental market in housing low income and disadvantaged people has grown considerably over time as public housing has decreased and home ownership has become more unaffordable. 30% of Australians rent their housing and the majority of renters are in the private rental market (Hulse et al., 2011). According to a report produced by the Australian Housing and Urban Research Institute more than a million lower-income households that comprise the lowest two quintiles of household income rent their housing and twice as many lower income households live in private rental compared to public housing (ibid.). Discriminatory opinions and practices pervade private rental markets and appear in the guise of discourses about risk and are driven by selection of the best (low risk, good rental history, capable of paying rent) tenant and landlord expectations and desires (Wallis Consulting Group, 2008). It is vital to include housing in the proposed Anti-Racism Strategy to address the fundamental needs and rights of the most vulnerable population groups in Australia. Objective One: Create Awareness Racism is a pervasive way of viewing minority groups or people who are conceived of and situated as other than the dominant culture. The experience of being other can exclude people from participation in the dominant cultures economic, social and political communities. Exclusion, in turn, contributes to disadvantage. Popular understandings of racism portray it as an explicit rejection of other groups and their members, as hostile and malevolent, as underpinned by a belief in the superiority of ones own group over others, and as a feature of individuals. These aspects characterise racism but there are other, much deeper issues that manifest as racist views between vulnerable groups of people. In research conducted among homeless people on the experience of homelessness, participants expressed concerns that the needs of refugees and asylum seekers were given higher priority than the needs of what was referred to as Australians (Spinney and Nethery, 2012). The researchers reported that homeless participants were concerned that refugees and asylum seekers were taking our houses (ibid.). Anecdotally, racist views are expressed at points where access to rights and resources is in contention and as a means to contest and justify claims over rights and resources. Competition for scarce resources, such as housing, contributes to divisiveness in communities (Crow, 2006) and fuels racism. It has been suggested that such hostility stems from a deeply embedded insecurity amongst the Australian population that is inherent to historical and contemporary policy approaches such as the White Australia Policy and mandatory detention (McMaster, 2002, Spinney and Nethery, 2012). Racism and disadvantage are experienced in housing provision by CALD and Indigenous people and refugees and asylum seekers who are predominantly housed in the private rental market. In the private rental market discrimination and racism are often masked or concealed by such terms such as risk, profitability and the time-poorness of real estate agents (Wallis Consulting Group, 2008). In some cases tenancy expectations between tenants and landlords can differ and these differing expectations can lead to disputes and eviction. House design and the way that people are expected to inhabit a house is based on a Western nuclear family model and accompanying tenancy expectations (such as garden maintenance) are similarly based on mainstream assumptions and expectations. Public and social housing policy and service provision is mainstreamed, which can have a negative impact on CALD and Indigenous people and refugees and asylum seekers because of house design, tenancy rules and regulations. Mainstreamed and inflexible systems often conflict with cultural norms and imperatives. For example, Indigenous people are culturally obliged to accommodate family and move from one place to another for sorry business and as a method of resolving conflict (Elvin et al., 2010). Existing regulations can enforce punitive measures, such as increased rent in public housing properties when tenants fulfill their cultural obligations. While social factors demonstrate disadvantage, from an Indigenous perspective, the heart of that disadvantage lies in the fact that traditional land rights have not always been recognised. Indigenous rights to lands were removed without any form of compensation, recognition or acknowledgment that Indigenous people had occupied lands, had customary custodial responsibilities to lands, and finally, had powerful ancestral relationships with those lands. Following the Mabo decision in 1992, the Native Title Act has provided a means for Indigenous people to re-claim ownership over their custodial lands. It must be noted however, that native title claims can be arduous, distressing and divisive for the claimants (Glaskin, 2007) and do not give right to tenure on the land nor do they solve housing issues faced by Indigenous people living in urban areas and regional towns. It has also been noted that there is a lack of public support for native title owing to assumptions and stereotypes about unequal rights, which is often sensationalised by politicians and the media which only fuels racist tensions (Aboriginal and Torres Strait Islander Social Justice Commissioner, 2011, Price, 2006). To bring about change it is necessary to address mainstream policies and practices as a facet of systemic racism in Australian society. Policies, such as mandatory detention, essentially codify social norms and expectations and perpetuate these norms through regulations and legislation. Racism is also perpetuated through media and the use of terms such as boat people that has transplanted the term asylum seekers in the Australian vernacular. It is indeed a sad state of affairs when the opposition leader Tony Abbott refers to asylum seekers as boat people. Education is needed to prompt changes in these areas that fundamentally shape and perpetuate racist beliefs and opinions. Often people do nothing about racism and claim that they are not racist, but fail to recognise that such a position only reinforces the status quo. It is stated in The People of Australia: Australias Multicultural Policy that an enduring theme of Australias multicultural policy is that everyone belongs (5 emphasis added). In order to realise a united and harmonious Australian community where everyone belongs there is an urgent need to first help people achieve what is both a fundamental need and right housing. To be appropriately, affordably and securely housed is the basis on which relationships can be formed. Establishing supportive human relationships are the foundation of building a sense of community and belonging to where people live. The capacity and opportunity to participate in pre-employment activities, employment, education and sport are integral to social participation (see Refugee Council of Australia, 2010). Many of these activities are delivered at the community level and are referred to as community development activities. Community development activities involve the targets of the initiatives in planning and implementation and increase a sense of ownership over initiatives, leading to more successful outcomes. Recommendation: Establish education in schools that presents an accurate history of Australia and does not perpetuate negative stereotypes, but portrays Indigenous people as our nations First Peoples. Recommendation: Establish education in government, non-government and media organisations to ensure appropriate use of terms in workplaces and public content in an attempt to control fear-mongering that perpetuates racism. Recommendation: Commonwealth Government to fund and build on community development initiatives to foster social capital within communities working towards 70% of housing and homelessness grants including community development activities. Recommendation: Ensure that media producers abide by the anti-discrimination act and encourage the promotion of positive stereotypes and good news stories about refugees and asylum seekers and CALD and Indigenous people. Recommendation: It is crucial that the issue of land rights is confronted in the Anti-Racism Strategy, particularly in the context of amending Indigenous homelessness and improving the provision of appropriate housing. Objective Two: Building on Good Practice As highlighted in this submission, language is often a barrier to securing private rental. A number of good initiatives currently occur to assist the building of social capital and support people in their housing including the Telephone Interpreter Service (TIS) National Pilot Project, informal working relationships between community service providers (e.g. organisations that provide housing assistance) and real estate agencies, the private rental liaison officer (PRLO) program run in South Australia that supports people who are struggling to access the private rental market to gain and maintain tenancies and campaigns such as all together now. It has been noted that real estate agents and landlords are only vaguely aware of the Equal Opportunities Act (Wallis Consulting Group, 2008). Real estate agents are also often responsible for a large portfolio of properties and the time that it takes agents to liaise between potential tenants and interpreters is a significant barrier to housing refugees and asylum seekers and CALD and Indigenous people specifically. Conducting education about discrimination and racism is a means of raising awareness that could potentially be enacted through licensing, regulation and accreditation of real estate agents and landlords. Recommendation: Establish national guidelines with an associated accreditation process for State-based real estate agents and landlords about the rights, obligations and benefits related to the Equal Opportunities Act and housing CALD, Indigenous and refugees and asylum seeker tenants. Recommendation: Develop and promote a National CALD/Indigenous-friendly accreditation. Recommendation: Lobby state governments to expand the PRLO program to increase the number of PRLOs to support vulnerable tenants to access housing. Recommendation: Advocate for and fund high quality research, evidence-based policy provision and responsive and inclusive legislation as the fundamental basis for developing and maintaining good practice. Objective Three: Empower Communities and Individuals It is stated in principle 2 in The People of Australia: Australias Multicultural Policy that: The Australian Government is committed to a just, inclusive and socially cohesive society where everyone can participate in the opportunities that Australia offers and where government services are responsive to the needs of Australians from culturally and linguistically diverse backgrounds. (5 emphasis added) Adequate support is fundamental to accessing housing and achieving successful tenancies in public and private housing. Currently the support services for refugees and asylum seekers and Indigenous people are inadequate to meet demand and often do not extend to support before, during and after open inspections for private rental, or the life of the tenancy. In the public housing system, there is a lack of cultural awareness and competency training and anecdotal stories of poor service provision. Processes around proof of Indigeneity can act as a barrier to applying for public housing and there should be a standard approach to this across Australia, such as a statutory declaration signed by a Justice of the Peace, with support provided to obtain it. Recommendation: Lobby the Commonwealth Government to provide more comprehensive housing support services through the Humanitarian Settlement Scheme and recognise the distinct status of Indigenous people as First Peoples in housing policy, resource allocation and housing service provision. Recommendation: Lobby for the empowerment of individuals and communities by enabling them to take control of their lives through low-cost home ownership schemes, low-cost housing options and culturally appropriate accommodation opportunities. Conclusion Housing is an area in which refugees and asylum seekers, CALD and Indigenous people suffer discrimination and racism. Housing is a basic human right and a fundamental need and the failure to house some of the most vulnerable populations in Australia can and does cause and perpetuate homelessness. The high representation of Indigenous people in homelessness statistics bears out this fact. Racism and discrimination is deeply enmeshed within individuals, institutions and everyday practices and systems. A public awareness campaign would be a good beginning to address negative stereotypes but on its own will not be enough to change this situation, especially when campaigns that concentrate on racial tolerance are paired with media that reinforces negative stereotypes. Providing information is only one part of the story, it is essential to create supportive environments that enable people to positively work against discrimination and advocate against racism.
