The result of this discussion was a proposal for the development of an Advisory Note (the Note) on the use of mobility scooters in and around Club premises. Supporting the partnership between the Commission and the RSL & Services Clubs Assocn are Clubs NSW, Leagues Clubs Australia and Bowls NSW. Scooters are increasingly used by all ages as a mobility aid; older or less mobile people who have difficulty walking long distances use them and younger people with a physical disability. They have become an indispensable form of transportation for a large number of people who wish to keep their independence and maintain their wellbeing and engagement with their communities. The exact number of scooters in Australia is difficult to quantify because scooter users are not required under Australian road rules to register their device (other than Queensland) and are considered the same as pedestrians. As a pedestrian, scooter users must observe the road rules applied by bodies such as the NSW Roads and Maritime Services. In June 2012, the Australian Competition and Consumer Commission (ACCC), NRMA Motoring & Services, CHOICE, EnableNSW, Flinders University and a number of other stakeholders worked together on Australias first national survey of mobility scooter users named Mobility scooter usage and safety survey. The results demystified current community assumptions that the majority of scooter users are elderly and clearly established that more than 50 per cent of scooter users were aged less than 60 years. The survey found that without their scooters, many would be housebound and dependent upon family, friends and carers. The research findings included the following: Scooter users cannot be characterised just as elderly road users, with over 50 per cent of scooter users aged less than 60 years. Scooter users know themselves to be (and behave as) pedestriansthis is consistent with the Australian Road Rules. Scooter users highly value the independence their scooter gives them and do not generally replace a car with a scooter. Rather, they use a scooter to replace their legs when they are no longer able to walk long distances. The majority of users use additional safety features and generally feel safe on their scooter. Scooter users blame factors out of their control (e.g. environmental factors) for any lack of safety. 鱨վ 95 per cent of trips on a mobility scooter involve no injury or damage of any kind. Mobility scooters are a lifeline to independence and emotional well-being, making it imperative to find a way to ensure it is safer and easier for road users to incorporate scooters into the transport mix. Inherently, scooters are safe as a mode of transportation. However, there is mounting community concern over safety issues. A report published in March 2011 by Monash University targeted at injuries related to scooters found that 62 Australians aged between 60 and 90 have died from collisions or falls since the year 2000 and hundreds more have been hospitalised as a result of falling or losing control of their scooter. People choose scooters as their preferred form of transportation for one or more of the following reasons: They have some kind of impairment that prevents long distance walking, or are unable to walk They have relinquished (either voluntarily or by necessity) their car licence They do not want to be isolated at home, dependent, or institutionalised They wish to do something about their carbon footprint by reducing their dependency on cars. The Clubs have identified the need for an effective and coordinated approach to responding to changes in the community and in particular the needs of patrons with disabilities and ageing patrons who may be impacted by mobility impairments and require the use of a scooter as an aid to mobility. Consultation with people with disabilities and access experts Consultation with people with disabilities, their representative organisations and access experts is an essential part of achieving a broad a scope of advice for the development of this Note. The draft was placed on the Commissions website for public comment prior to its launch on June 30th 2014. [NOTE: This section needs to be expanded to include the issues paper and the two consultation meetings.] Definitions and Glossary of Terms Disability Section 5 of the DDA expresses the general principle that discrimination occurs when a person with a disability is treated less favourably than a person without a disability would be treated in the same or similar circumstances. The DDA is concerned therefore with equity and human dignity. See Appendix 1 for greater detail. Mobility Scooters For the purposes of this Note, mobility scooters are battery powered three or four wheeled mobility devices that are specifically designed to travel on footpaths and for one user only. They are a simple vehicle with few working parts, requiring a relatively low level of maintenance. In general, scooters have a maximum speed of less than 10 kph. They are activated by a simple throttle, operated by the fingers, which controls both speed and braking. Steering is via a variety of types of handlebars that operate in a similar fashion to push bikes or motor bikes. They come with varying equipment levels, from twin headlights, blinkers and visibility flags. Accessible Accessible means having features to enable use by people with disabilities. This includes, for example: Good paths of travel to, into and around a building that can be safely used by people with different disabilities Enough room around and through doorways, in lifts and toilets for people using wheelchairs or other mobility aids Signage to assist people to identify toilets and what level they are on in a lift Handrails on stairs and ramps and highly visible strips at the front of a step to make them safer to use Light switches and controls at accessible heights Good fit out of accessible toilets to enable use by people with disabilities using a wheelchair or other mobility aid Technical details on how to make sure these and other features are accessible are found in a number of Australian Standards. Continuous accessible path of travel A continuous accessible path of travel is an uninterrupted route to and within a building providing access to all features, services and facilities. It should not incorporate any step, stairway, turnstile, revolving door, escalator, hazard or other impediment which would prevent it from being safely negotiated by people with disability. Some of the key features of a continuous accessible path of travel are: Minimum 1000mm wide (850mm clear opening at doorways) Minimum 2000mm height with no overhead obstructions (1980mm at doorways) Ramps with gradients of 1 in 14 or less Firm, even and slip-resistant ground surfaces High luminance (contrast) markings across fully glazed doors or other glazing that might be mistaken for a doorway Technical details on how to make sure these and other features are accessible are found in a number of Australian Standards. Scooter safety Safety is dependent on users having the necessary safe scooter operation instructions, enough strength, physical ability and understanding to operate and manoeuvre mobility scooters safely. Premises The definition of premises in the DDA extends to the whole of the built environment. It includes: existing buildings, including heritage buildings; new or proposed buildings; transport systems; car parks, sports venues, pathways, public gardens and parks. Patrons Members or guests of Clubs will be referred to as patrons. Advisory Note Purpose The purpose of this Note is to provide: information about the application of disability discrimination law in regard to the use of scooters in and around Clubs information on the rights, responsibilities and reasonable expectations of both Clubs and scooter users a range of useful ideas, resources and references to assist in improving understanding of scooter use. There are no Australian Standards for scooters or rules for scooter use. However, this may change in the next 12 months. Scooters are tending to have a larger footprint, are heavier than motorised wheelchairs and have greater difficulty with manoeuvrability, especially inside buildings. As a consequence there have been some concerns in regard to the use of scooters in and around publically accessible buildings. This note will mitigate the risk of a DDA complaint against clubs and facilitate club members to take full advantage of their club membership. The Note, while dealing with the use of scooters within and around Clubs could be used in other premises accessible to the public. Scope The scope of this Note refers only to the use of scooters in and around the publically accessible buildings of registered Clubs. The Note does not include provisions for other types of mobility devices - for example motorised wheelchairs that have a different function and manoeuvrability for users. Legal responsibility to not discriminate Disability Discrimination Act 1992 (Cth) The DDA makes disability discrimination unlawful and ensures that people with disability have the same rights and level of access to opportunities, premises and services as other members of the community. Specifically: Section 23 Access to Premises of the DDA makes it unlawful to discriminate against people with a disability, or their associates, in relation to access to, and use of, premises that the public is allowed to enter or use. Section 24 Goods, services and facilities makes it unlawful for a person, or organisation, to discriminate against people with disability in the way they provide goods or services or make facilities available. Additionally, Australia ratified the United Nations HYPERLINK "https://www.humanrights.gov.au/our-work/disability-rights/international/disability-rights-international-convention-human-rights-and" Convention on the Rights of Persons with Disabilities in 2008 (Appendix 1). Examples of potential discrimination that would particularly affect people with mobility disability include: entrances located in a position that require a person to be able to walk up steps to get to or through the entrance doorways that are too narrow for a person using a wheelchair to get through areas of buildings such as a restaurant or gaming room that can only be approached up a stairway The DDA also makes it unlawful for a person or organisation to discriminate in relation to carers, assistants, assistance animals or disability aids. Section 9 of the DDA states that a disability aid is equipment used by a person with disability that provides assistance to alleviate the effect of their disability. Scooters used by people to alleviate the effect of their disability would be regarded as a disability aid under the DDA. In general, therefore, it would be unlawful to refuse entry to a Club to someone who uses a scooter where it is being used as a mobility aid. It may also be unlawful for a Club to restrict access to certain areas unless there was a valid reason to restrict access. People or organisations who discriminate against people with disability are faced with the possibility of a complaint being made against them. It is possible to defend a complaint by showing that providing equal access would result in an unjustifiable hardship. For more details on the DDA and Unjustifiable Hardship refer to Appendix 1. If a complaint of discrimination is made under the DDA the Commission would attempt to conciliate an agreement between the parties. If the complaint is not resolved or is discontinued for some other reason, the complainant has 60 days from when the Commission finalises the complaint to make an application to the Federal Magistrates Court or the Federal Court of Australia to seek a formal determination on whether or not discrimination had taken place and whether or not the respondent had shown the defence of unjustifiable hardship. Legal status of this advice Matters not covered by the Disability (Access to Premises - buildings) Standards 2010 (Premises Standards), such as those addressed in these Advisory Notes, are covered by the general non-discrimination provisions of the DDA. Individual complaints must be dealt with on a case-by-case basis with courts making final determinations on whether or not unlawful discrimination has occurred. Because of this the Commission can only offer advice about what levels of access may reduce the chances of a successful complaint being made. The actions suggested in this Note are not mandatory and the Note does not have the force of law. The Note has been prepared by the Commission to assist Clubs and patrons to understand their existing responsibilities and rights under the DDA and to assist in identifying ways to avoid possible discrimination complaints. Although prepared with advice from people with expertise in access issues, the Note should not be taken to represent the views of any person or organisation other than the Commission. Rights and responsibilities of Clubs Safe and considerate use Clubs have the right to expect their patrons to behave in an appropriate manner according to their code of conduct and membership guidelines or rules. They may also, because of their obligations under workplace health and safety laws, require patrons to behave respectfully to management, staff and fellow patrons and to drive their scooters in a safe manner. See the section on Scooter safety above and section 4 below on Notes on reasonable expectations below. Clubs have the right to communicate their reasonable expectations of scooter users within their premises and the services and facilities they offer including identifying any areas of the building or restrictions on access considered necessary given the limits of the existing building. It would be reasonable to create a communication strategy specific to each Club that provides: Expectations for safe usage of scooters within and around the Club Welcoming signage about parking scooters Posters or a building map that gives people information on the layout of the facilities and where accessible facilities, ramps, elevators and parking areas are located. Brochures or a map that gives information about areas of the building to which scooter users might not be able to get to or safely use because of existing design or facility limitations. The brochure or map might identify narrow doorways, areas where limited weight restrictions apply and areas where the parking of scooters might cause hazards for other users. Information on the whereabouts of emergency exits Brochures that explain scooter etiquette Information on personal public liability insurance Information about insurance against theft or damage Improving access Where there are areas of Clubs that, because of their design, might result in limited access being available Clubs have a responsibility to try to address those limits over time in order to avoid unlawful discrimination. In order to do this individual Clubs may need to develop an assessment of current access provisions, identify deficits and develop an action plan or building upgrade plan to address those issues where this would not result in unjustifiable hardship. See Appendix 2 for information on minimum requirements for building access for new and upgraded buildings. See Appendix 3 for more information on Action Plans and building upgrade plans. Refusing admittance Where a Club is concerned a patron is not using their scooter in a safe and considerate manner the Club has the right to refuse entry on the grounds of safety for staff and other patrons or to ask a scooter user to leave the premises. However, before doing so they should ensure they have taken all reasonable steps to ensure the patron has access to information on safe and considerate use, understands that information and has the opportunity to demonstrate their ability to meet reasonable expectations. Discrimination by staff Clubs have a responsibility to ensure staff do not discriminate against patrons. A failure on the part of staff to respond equitably and appropriately to the requirements of people with disability can lead to significant discriminatory barriers. If staff are not adequately trained in customer services they could act in a way that effectively denies a person with disabilities access to, and use of, premises. This could result in complaints of discrimination being lodged. People who own, lease, operate and manage premises may be liable if staff behave in a discriminatory way unless they can show they have exercised due diligence and taken reasonable precautions to avoid discrimination occurring. They should consider the following strategies for addressing possible discrimination by staff against people with disability: Make all staff aware of the need to avoid discrimination. Depending on the nature of the enterprise, this might include issuing a formal policy statement on compliance with discrimination law and more direct advice to staff. Take reasonable measures to give staff sufficient information and expertise to make services and facilities available in a non-discriminatory way. This may include the provision of formal disability awareness training. Establish and promote effective complaints handling procedures regarding discrimination and ensure that these complaint procedures are accessible to people with disability and appropriately advertised. Ensure effective communication with people with disabilities including people with a communication impairment. The effective communication strategy could also provide advice on initiating those respectful conversations with users about declining health or ability to safely operate a scooter when necessary. Rights and responsibilities of patrons Use of scooters in and around Clubs Patrons have the right to use scooters in and around Clubs where the scooter is a disability aid used to alleviate the effect of a disability. Where, because of limits in an existing building, there are areas where access is limited or unsafe patrons have the right to lodge complaints of discrimination and expect improvements would be made over time unless the removal of barriers would result in an unjustifiable hardship for the Club. Safe and considerate use Patrons have a responsibility to behave in an appropriate manner according to the code of conduct and membership guidelines or rules of their Club. Scooter users have a responsibility to behave respectfully to management, staff and fellow patrons and drive their scooters in a safe and considerate manner. Scooter users have the right to receive information on: Expectations for safe usage of scooters within and around their Clubs Parking scooters The layout of the premises and where accessible facilities, ramps, elevators and parking areas are located. 鱨վ areas of the building where scooter users might not be able to get to, or safely use, because of existing design or facility limitations. This might identify narrow doorways, areas where limited weight restrictions apply and areas where the parking of scooters might cause hazards for other users. The whereabouts of emergency exits That explain scooter etiquette Personal public liability insurance Insurance against theft or damage Refusal of admission Where a Club believes a patron is not using their scooter in a safe or considerate manner the Club has the right to refuse entry on the grounds of safety for staff and other patrons. In this case patrons have the right to expect the Club carefully and respectfully communicates their expectations and provides an opportunity for the patron to demonstrate their ability to meet reasonable expectations of safe and considerate use. See the section on Scooter safety above and section 4 below on Notes on reasonable expectations below. Notes on Reasonable Expectations Parking for Scooters All Clubs are different sizes and have different access provisions inside and out. Each club will have to assess the most appropriate spaces to provide parking for scooters. In respect to Clubs that have space to provide designated space for parking for scooters, there will need to be clear signage about their whereabouts, whether it is inside the building or outside. Inside buildings, the designated spaces need to be clear of main pedestrian traffic areas, entries, exits and emergency exits. If there are no options for parking inside the venue, parking outside or on a footpath needs to be clear of the perimeter building line by a minimum of 1.5 metres to abide by local Council local laws and Footpath trading guidelines There is no specific standard for the clear space required for pedestrians and Councils guidelines can vary between 1.5m and 2m clear unobstructed walkway space. Clubs should check with the respective Council on these requirements as they may vary from Council to Council. If Clubs need assistance, they can seek out an access specialist to make recommendations on appropriate parking spaces. Speed All scooters are speed limited, meaning that they are set to have a minimum and a maximum speed, and variable in between. The speed dial is either numbered, with the lowest number representing the lowest speed or more commonly, represented by a diagram of a hare and a tortoise. Many scooters can be reprogrammed to adjust the speed to suit its use and the ability and weight of its user. Users should be encouraged to use the slowest speed possible when inside or within a crowded area. In general, applying signage to travel at a designated speed of 3 km per hour may not be appropriate for some users. Therefore a general statement about travelling at a walking pace is the recommended option with a hint that if you are passing people who are walking, then you are travelling too fast. Accessible spaces and way finding After Clubs have undertaken an assessment of their access provisions, they may identify where scooters are permitted to go and to park. They can provide a handout about accessible routes of travel in an accessible format or signage in public view. Size of scooters Scooters come in a variety of sizes and shapes to suit the differing needs of users. All the minimum dimensions in building laws are based on research that looked at people who use wheelchairs and not people who use motorised scooters and assume a basic maximum occupied wheelchair footprint of 800 mm wide x 1300 mm long. Building laws define the minimum requirements for building construction. Hence, there are no minimum or maximum dimensions for the width, length or turning space requirements for scooters in building laws People selling, recommending and purchasing scooters need to be aware of these dimensions and turning space requirements when making choices about which scooter is suitable if the intended use includes travel inside buildings. Occupational therapists help people with disabilities to select the type of scooter most appropriate to their needs and therefore it is impossible to standardise size, weight and shape. If a Club is compliant with the most recent building laws and upgrades and a scooter is unable to enter parts of the building one could presume that it is an unreasonable expectation to have to face a formal complaint or make further changes to the structure of the building. The onus would be on the purchaser to consider a more practical version of the scooter that can access all compliant buildings. As an example of this, one person with a disability has commented: People with disability need to carefully consider their mobility aid purchase in the first place and base their decision on not only their disability but think about where and when they wish to use that device. For instance if I frequented a beach I would either purchase a 4 wheel drive wheelchair or other similar aid I would not expect the beachside council to provide access over sand and water etc. for a wheelchair that was for inside use. The same as I would not purchase an oversize scooter if I was frequent rail user knowing full well that only an average mobility aid is catered for. In Australia, the Therapeutic Goods Administration (TGA) regards scooters as a Medical Device. However some retailers may import non TGA compliant scooters. Currently Australia has no specific mandatory standards for scooters. Australian Standards for scooters are voluntary. [Note: Austroads is working on the development of a regulation process for mobility scooters. This will be referred to in the final draft] Each state has the capacity to identify their own maximum requirements. It would be in the interests of all manufacturers and retailers of scooters to initiate a set of recommendations for use on public transport and access to premises and alert purchasers to the restrictions of those machines outside the scope of public transport maximum requirements. Turning spaces The turning space in the current premises standards drafted for wheelchairs is: Area needed on a corridor to enable a wheelchair user to turn 90 1500 mm x 1500 mm minimum Area needed on a corridor to enable a wheelchair user to turn 180 1540 mm x 2070 mm minimum (Appendix 2) Australian Road Rules for Scooter use There are no standards for scooters in Australia. However, the Australian Road Rules consider scooters the same as motorised wheelchairs. The rules that apply are the same as those that apply to pedestrians. Under the Australian Road Rules, a person using a motorised wheelchair or scooter is classified as a pedestrian and: Cannot travel at a speed greater than 10 km/h on level ground Must have an unladen weight of less than 110kg Can only travel on the road where a footpath is not available, is being repaired or is unsafe due to damage Must keep as far to the side of the road as possible and face oncoming traffic if no footpath is available Must observe all the same road rules that apply to pedestrians Must not use the motorised wheelchair with a blood alcohol concentration of 0.05 or more Must not carry any passengers. Note: This section may need to be updated to take Austroads project into consideration. Circulation around fixtures and fittings In addition to addressing possible access barriers in the design and construction of the Club premises consideration should be given to ensuring the best possible circulation around fixtures and fittings. This might include the re-positioning of movable cupboards, chairs, tables, ATMs, public telephones, food and drink dispensers and similar items so as to improve access and circulation. The Premises Standards require corridors and doors to have the following minimum widths: Corridor width minimum 1000 mm Passing spaces along corridors (where required) 1800 mm wide x 2000 mm long minimum Clear door leaf opening minimum 850 mm Width of corridor outside a doorway entry into a room varies according to approach and the way the door swings but generally the corridor at this point is required to be wider than the 1000 mm minimum. Damage to property It is reasonable to expect that any patron of any club will not damage property either intentionally or unintentionally. It is reasonable therefore that Clubs would expect patrons who may damage any part of the building because of unsafe handling of their scooter, would be liable for the costs of repairs. Note: This will need to be checked with Legal. Injury to scooter users and/or other patrons Both mobility scooter users and club operators should minimise the risk of injury to scooter users and other patrons. Scooter users are encouraged to purchase public liability insurance. Most Clubs would have their own public liability insurance provisions to cater for any injury claims by other patrons. Further actions that could also be taken to improve experiences for patrons This Note has been developed to provide guidance to Clubs about disability discrimination law and to support patrons of the Clubs to take full advantage of their Club membership. Following the advice in the note will mitigate the risk of a DDA complaint. As mentioned, with an increasing number of people choosing scooters as their disability aid, it is recommended that Clubs take a proactive approach to scooter users to anticipate a greater percentage of scooter users accessing their premises. The following list includes ideas that can improve the Club experience for all stakeholders into the long term. Recharge facilities Scooter users may need to recharge their battery in order to get home safely. A power point installed at an accessible height of 1m in designated parking areas is all that is needed. Users would carry their own recharge cords. For safety reasons the power point would need to have a safety mechanism or circuit breaker fitted. Communication Provide Mobility maps sourced from Council Provide information about the scooter recharging option Make available scooter safety guidelines sourced from the NSW department of transport Provide training to relevant staff about ways to communicate those difficult conversations in a respectful and caring manner to patrons whose health and ability may have deteriorated to the extent that they should not be driving their scooter. Upgrading parts of the venue Make wheelchair/scooter friendly areas in gaming rooms, restaurants, bars Provide occasional seating for use by people who can only walk short distances at a time Provide temporary accessible clear spaces near toilets, reception and eating areas where practicable Provide larger toilets than minimum standards and ambulant toilet cubicles (whether upgrading or not) Widen all doorways to a minimum of 850mm. Safety The ability of a person to safely operate a scooter relies on: Coordination, strength, physical endurance and balance Perception, thought process and memory Feelings and judgement Safety procedures Etiquette inside buildings Scooter safety expo Most Councils will employ and Access Officer who is available to provide support for access related projects. A club representative could contact their local access officer and suggest facilitating a scooter safety expo for people who use scooters. This invitation could go to patrons and visitors and extend to the broader community. The expo could have stalls that provide advice on: Scooter safety equipment Scooter safety checks and setting speed inhibitors Hearing and vision tests Taxi requirements for transporting scooters Tyre safety Selecting appropriate insurance for public liability and scooter damage or theft. Guest speakers could include: Welcome by Club President and/or Mayor Occupational therapists to discuss safe scooter usage Council access officer to discuss Councils progress with access issues and other current projects. Section 3 of the DDA sets out its objects: (a) to eliminate, as far as possible, discrimination against persons on the ground of disability in the areas of: (i) work, accommodation, education, access to premises, clubs and sport; and (ii) the provision of goods, facilities, services and land; and (iii) existing laws; and (iv) the administration of Commonwealth laws and programs; and (b) to ensure, as far as practicable, that persons with disabilities have the same rights to equality before the law as the rest of the community; and (c) to promote recognition and acceptance within the community of the principle that persons with disabilities have the same fundamental rights as the rest of the community. The DDA covers a wide range of areas including employment, education, sport and recreation, the provision of goods, services and facilities, accommodation and access to premises. All levels of government, businesses, trade unions, non-government organisations and individuals have responsibilities under the DDA. The law seeks to stop discrimination against people with any form of disability including physical, intellectual, sensory, psychiatric, neurological, learning, disfigurement or the presence in the body of a disease causing organism. There are multi-dimensional aspects of the meaning of disability; a disability is made up of a physical/organic, cognitive, psychological or sensory impairment, coupled with the inability to fully function in a given environment to the same extent as a person who does not have an impairment. Effectively, barriers to accessing information, assistance, services and infrastructure cause and exacerbate disability and disadvantage in our community. The definition of disability covered by the DDA includes the following kinds of impairments: Physical Intellectual Psychiatric Sensory Neurological Learning disabilities Physical disfigurement The presence in the body of disease-causing organisms Section 4 of the DDA provides that the definition of premises includes: a structure, building, aircraft, vehicle or vessel; and a place (whether enclosed or built on or not); and a part of premises (including premises of a kind referred to in paragraph (a) or (b). The DDA covers existing premises, including heritage buildings, those under construction and future premises. The definition includes not only buildings, but also anything in the built environment including car parks, sports fields, parks, pathways and transport systems. People who believe they have been discriminated against because of their disability may make a complaint to the Commission. The Disability Discrimination Commissioner attempts to resolve these complaints by conciliation, however if conciliation is not possible a complaint may be referred to the Commission for a formal hearing and a decision. Section 23 Access to Premises provides: It is unlawful for a person to discriminate against another person on the ground of the other persons disability: (a) by refusing to allow the other person access to, or the use of, any premises that the public or a section of the public is entitled or allowed to enter or use (whether for payment or not); or (b) in the terms or conditions on which the firstmentioned person is prepared to allow the other person access to, or the use of, any such premises; or (c) in relation to the provision of means of access to such premises; or (d) by refusing to allow the other person the use of any facilities in such premises that the public or a section of the public is entitled or allowed to use (whether for payment or not); or (e) in the terms or conditions on which the firstmentioned person is prepared to allow the other person the use of any such facilities; or (f) by requiring the other person to leave such premises or cease to use such facilities. Section 24 Goods services and facilities provides: It is unlawful for a person who, whether for payment or not, provides goods or services, or makes facilities available, to discriminate against another person on the ground of the other persons disability: (a) by refusing to provide the other person with those goods or services or to make those facilities available to the other person; or (b) in the terms or conditions on which the firstmentioned person provides the other person with those goods or services or makes those facilities available to the other person; or (c) in the manner in which the firstmentioned person provides the other person with those goods or services or makes those facilities available to the other person. Examples of discrimination Examples of possible areas of discrimination that could result in a complaint by a person with a disability, their associates or representatives include: failure to provide equitable physical access to a premise inadequate signage for a person with a vision impairment using facilities within a premise failure to ensure facilities such as vending machines or counters within buildings are accessible or usable by people with a disability failure to provide suitable parking facilities for vehicles used by people with disabilities failure to provide a clear and safe access path in a building or on a pathway failure to provide equal amenity to people who have disabilities through inadequate management practices. Unjustifiable hardship Section 29A provides a defence of "unjustifiable hardship". A person or organisation may claim that providing a particular level of access would be technically impossible, impose major difficulties or involve unreasonable costs. Unjustifiable hardship is explained in section 11 of the DDA: (1) For the purposes of this Act, in determining whether a hardship that would be imposed on a person (the first person) would be an unjustifiable hardship, all relevant circumstances of the particular case must be taken into account, including the following: (a) the nature of the benefit or detriment likely to accrue to, or to be suffered by, any person concerned; (b) the effect of the disability of any person concerned; (c) the financial circumstances, and the estimated amount of expenditure required to be made, by the first person; (d) the availability of financial and other assistance to the first person; (e) any relevant action plans given to the Commission under section 64. Example: One of the circumstances covered by paragraph (1)(a) is the nature of the benefit or detriment likely to accrue to, or to be suffered by, the community. (2) For the purposes of this Act, the burden of proving that something would impose unjustifiable hardship lies on the person claiming unjustifiable hardship. Where equitable and dignified access to, and use of, premises has not been provided people with disabilities are entitled to complain. In those circumstances, a defence of unjustifiable hardship may be available to the respondent. Circumstances relevant to unjustifiable hardship may include: technical limits; topographical restrictions; the effect, both positive and negative, on other people of providing the required level of access, for example, people delivering goods, people with prams or trolleys and the staff; safety, design and construction issues; the benefit for people with disabilities; and the costs involved in providing access. The Commission is from time to time asked for its opinion of what constitutes unjustifiable hardship. It is not possible to make a general statement about unjustifiable hardship that would apply in all cases. What would be an unjustifiable hardship to one person or organisation may not be for another. The provisions of section 11 require assessment on a case-by-case basis and the Commission can only determine what amounts to unjustifiable hardship following a formal investigation into all relevant factors in the complaint handling process. The best way to avoid complaints would be to attempt to ensure access issues are addressed as fully as possible from the design stage onwards. The advisory notes are intended to assist in achieving that objective. Convention on the Rights of Persons with Disabilities Australia ratified the Convention on the Rights of Persons with Disabilities on 17 July 2008. It was one of the first nations to do so.. The Convention is an international instrument of the United Nations intended to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity. Article 9 of the Convention concerns Accessibility Article 9 - Accessibility 1. To enable persons with disabilities to live independently and participate fully in all aspects of life, States Parties shall take appropriate measures to ensure to persons with disabilities access, on an equal basis with others, to the physical environment, to transportation, to information and communications, including information and communications technologies and systems, and to other facilities and services open or provided to the public, both in urban and in rural areas. These measures, which shall include the identification and elimination of obstacles and barriers to accessibility, shall apply to, inter alia: Buildings, roads, transportation and other indoor and outdoor facilities, including schools, housing, medical facilities and workplaces; Information, communications and other services, including electronic services and emergency services. 2. States Parties shall also take appropriate measures to: Develop, promulgate and monitor the implementation of minimum standards and guidelines for the accessibility of facilities and services open or provided to the public; Ensure that private entities that offer facilities and services which are open or provided to the public take into account all aspects of accessibility for persons with disabilities; Provide training for stakeholders on accessibility issues facing persons with disabilities; Provide in buildings and other facilities open to the public signage in Braille and in easy to read and understand forms; Provide forms of live assistance and intermediaries, including guides, readers and professional sign language interpreters, to facilitate accessibility to buildings and other facilities open to the public; Promote other appropriate forms of assistance and support to persons with disabilities to ensure their access to information; Promote access for persons with disabilities to new information and communications technologies and systems, including the Internet; Promote the design, development, production and distribution of accessible information and communications technologies and systems at an early stage, so that these technologies and systems become accessible at minimum cost. Appendix 2 Premises Standards and Building Code of Australia Note on minimum dimensions and circulation space requirements to meet the minimum requirements of the Premises Standards and Building Code of Australia The Disability (Access to Premises buildings) Standards 2010 (Premises Standards) and Building Code of Australia (BCA) describe the minimum requirements for access for features such as doorway widths, wheelchair spaces in theatres, corridor widths, circulation areas around doorways and lift floor sizes. For new buildings and new parts or upgraded parts of existing buildings a building owner or operator can be confident that if they meet these minimum requirements they are meeting their legal responsibilities and cannot be subject to a successful complaint under the DDA. There is nothing to stop a building owner or operator going beyond the minimum requirements, however, and many developers do. Examples of minimum requirements in the Premises Standards and BCA include: Clear door leaf opening minimum 850 mm Corridor width minimum 1000 mm Passing spaces along corridors (where required) 1800 mm wide x 2000 mm long minimum Lift floor space for a lift travelling 12 m or less 1100 mm x 1400 mm minimum Area needed on a corridor to enable a wheelchair user to turn 90 1500 mm x 1500 mm minimum Area needed on a corridor to enable a wheelchair user to turn 180 1540 mm x 2070 mm minimum Width of space required in a theatre for a wheelchair user 800 mm minimum Width of corridor outside a doorway entry into a room varies according to approach and the way the door swings but generally the corridor at this point is required to be wider than the 1000 mm minimum All the minimum dimensions in the Premises Standards and BCA are based on research that looked at wheelchair users and not motorised scooter users and assume a basic maximum occupied wheelchair footprint of 800 mm wide x 1300 mm long. For new buildings and new parts of existing buildings if an owner or operator ensures that the minimum dimensions and circulation space requirements in the Standards are met, they are meeting their legal obligations irrespective of the size and circulation space requirements of wheelchairs or scooters. If a person with disability uses a scooter to alleviate the effect of their disability the scooter would be defined as a disability aid and is covered by the DDA. However, under the Premises Standards and BCA if a person purchases a scooter that, for example, is wider than would fit through an 850 mm doorway or one that could not turn in a corridor with a 90 change in direction in a 1500 mm x 1500 mm area they could not legally be successful in a discrimination complaint under the DDA. There are no minimum or maximum dimensions for the width, length or turning space requirements for scooters in the Premises Standards, which do not deal with any specific mobility devices. Rather, the Premises Standards and BCA define the minimum requirements for building construction. People selling, recommending and purchasing scooters need to be aware of these requirements when making choices about which scooter is suitable if the intended use includes travel inside buildings. Existing buildings The situation is not as clearly defined in existing buildings, however, as all existing buildings built before the Premises Standards came into force1 May 2011continue to be subject to the general no-discrimination provisions of the DDA (and state and territory discrimination laws). This means that with existing buildings if a person with disability uses a scooter to alleviate the effect of their disability and they cannot get into an existing building using their scooter or cannot move around in the building on their scooter because doors or corridors are too narrow they have a valid discrimination complaint no matter how wide the doorway or how wide their scooter. In this case, if a complaint could not be resolved through conciliation or agreement between the two parties, the complainant may proceed to formal determination of the complaint. This would require the court or tribunal to consider whether the building owner or operator had a valid defence that making the changes to the building to accommodate the scooters size and circulation requirements would impose an unjustifiable hardship on them. An assessment of possible access difficulties in existing buildings and the development of a building upgrade plan to address those difficulties over time would significantly assist in avoiding complaints. Appendix 3 - Action plans and building upgrade plans The DDA provides for the development of an Action Plan which sets out how an organisation may identify and deal with discrimination. An Action Plan could be developed which shows how premises might be modified and management practices changed over time to achieve equality. An Action Plan is one of the matters that must be considered by the Commission when a claim of unjustifiable hardship is assessed. Any organisation can choose to make an Action Plan under section 61 of the DDA and lodge it with the Commission. An Action Plan can be revised at any time and can establish priorities for change over a number of years. A planned upgrade of buildings to meet the current requirements would be advisable and greatly reduce the chances of complaints. For owners, operators, managers and lessors of existing premises, an Action Plan could be a significant step in both reducing discrimination and deterring complaints. The essentials of an Action Plan as set out in section 61 of the DDA are: policies and programs to achieve the objects of the DDA how these policies and programs to persons will be communicated to your staff a review that identifies any discriminatory practices reasonable goals against which the success of the action plan may be measured the way in which policies and programs will be evaluated appointment of persons within the service provider to implement the action plan.
